Terms of service

These terms are an agreement between you and Ali3N Studios LLC ("we", "us"), a Texas limited liability company, about your use of BeatFractal at beatfractal.com (the "service"). By creating an account or using the service you agree to them. If you do not agree, do not use the service.

What BeatFractal is

BeatFractal lets you pair a song with music visualizers and render the result as a video file. The rendering happens in your browser, on your device: your songs, artwork and videos are not uploaded to us.

Your account

• You must be at least 13 years old, or older if the law where you live requires it, to use the service. To buy anything you must be an adult, or have a parent or guardian's permission.
• Give a real email address and keep your password and any two-step codes to yourself. You are responsible for what happens under your account. Tell us at once if you think someone else has used it.
• You can delete your account at any time from your account page. We may suspend or close an account that breaks these terms, after telling you why where we reasonably can.

Plans and payments

• Free: every visualizer and feature, with renders at 480p and a small BeatFractal.com mark.
• Single Video: a one-time payment that unlocks full-quality renders (1080p or 4K, no mark) for one project, meaning one song file, for 7 days from purchase.
• Pro: a subscription that unlocks full-quality renders for every project. Pro renews automatically each month or year, at the price shown when you subscribed, until you cancel. Cancel any time from your account page ("Manage subscription"); Pro then runs until the end of the period you have paid for and does not renew. If we change the price, we will tell you by email at least 30 days before it applies to you, and you can cancel before then.
• Prices are shown before you pay, with any tax added at checkout. Payments are processed by Stripe; we never see or store your card number. When a purchase is sold through Link, Stripe's merchant-of-record service, Link is the seller of record for that payment and its terms also apply to it.
• If a renewal payment fails, Pro stops until it is paid.
• Refunds: see refunds and cancellation. You can have a refund on any purchase within 14 days, no questions asked.

Your music and what you make

• You may only use music, artwork, logos and text that you own or have permission to use. BeatFractal never receives your song, so it cannot check; that responsibility is yours, as it is on the platforms you publish to.
• We claim no ownership of the videos you make.
• The visualizers are MilkDrop presets created by their authors over many years, credited where the author is known. We make them available to use within BeatFractal. We do not own them, and we make no promise that their authors permit any particular use of the videos you make with them. If that matters for your use, check first.

Fair use of the service

Do not: break or get around the service's security, limits, plans or the BeatFractal.com mark on free renders; use it to break the law or anyone's rights; copy or resell the visualizer library or the service; overload or attack it; or share your account. We may remove a visualizer, or change or stop features, at any time.

Disclaimers

The service is provided "as is" and "as available". Rendering depends on your device and browser, and we do not promise that every visualizer will work on every device, that renders will always succeed, or that the service will be uninterrupted or error-free. To the fullest extent the law allows, we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement.

Some visualizers flash. Those we found flashing more than three times a second with some music are marked, and can be hidden. If you or your viewers are sensitive to flashing light, take care.

Limits on liability

To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill. Our total liability for any claim about the service is limited to the greater of what you paid us in the 12 months before the claim, or 50 US dollars. Some places do not allow these limits, so they may not all apply to you; nothing here limits rights you have that cannot be limited by contract.

You agree to cover our reasonable costs if a claim is brought against us because of music or other material you used in breach of these terms.

Changes to these terms

We may update these terms. If a change matters, we will tell you by email or in the service before it takes effect. Continuing to use the service after that means you accept the new terms; if you do not, you can delete your account, and ask for a refund under the refund policy.

Law and disputes

These terms are governed by the laws of the State of Texas, United States, without regard to its conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Texas, unless the law where you live gives you the right to bring them elsewhere. Please contact us first: most problems are solved by an email.
